1Information We Collect

a. Information You Provide Directly

• Identifying information: name, date of birth, mailing address, email address, phone number, and Social Security number;
• Residency and history information relevant to RECA eligibility, including places and dates of residence, employment, or presence during the qualifying period (January 21, 1951 – November 6, 1962, or the relevant onsite-participant or uranium-worker period);
• Health and medical information, including cancer or other diagnoses, treatment history, and medical records or authorizations to obtain them from healthcare providers;
• Vital and government records, such as birth certificates, death certificates, and proof of relationship (for spouse or survivor claims);
• Financial and payment information necessary to process any administration or attorney fee upon a successful claim;
• Communications you send us, including recordings of intake calls or video consultations, where permitted by applicable law and with appropriate notice;
• Signatures and related metadata collected through e-signature platforms.

b. Information Collected Automatically

• Standard website usage data, such as IP address, browser type, device type, pages visited, and referring URL, collected through cookies or similar technologies (see Section 8).

c. Information From Other Sources

• Records obtained, with your authorization, from healthcare providers, government agencies, and other records custodians;
• Information shared with us by your attorney or, where you are a referral, by the person who referred you.

2How We Use Information

We use the information described above to:

• Screen and evaluate potential eligibility for compensation under RECA;
• Prepare, organize, and manage documentation in support of a claim;
• Communicate with you about your claim, including scheduling and status updates;
• Coordinate with your attorney, records custodians, and, through your attorney, the U.S. Department of Justice;
• Process payment of the claims administration fee upon a successful claim;
• Maintain internal case files and comply with our recordkeeping and professional obligations;
• Operate, secure, and improve the Site; and
• Comply with applicable law.

We do not use your health or diagnosis information for advertising or marketing purposes, and we do not use it to make automated decisions that produce legal or similarly significant effects concerning you.

3How We Share Information

We share information only as necessary to provide our services, and in the following circumstances:

• With your attorney (currently Nathan Anderson of Anderson Injury Law, LLC), who provides legal review and files claims on your behalf. You authorize this sharing when you sign the Claims Administration Agreement;
• With records custodians (such as hospitals, physicians, and vital records offices), solely to request and obtain records pursuant to an authorization you sign;
• With the U.S. Department of Justice, through your attorney, in connection with the filing and processing of your claim;
• With service providers who perform functions on our behalf under contract, including our customer relationship management (CRM) platform, secure document storage providers (Google Drive and ShareFile), e-signature providers (such as DocuSign and S-Sign), and workflow automation providers. These providers are authorized to use your information only as needed to provide services to us;
• As required by law, court order, or governmental request, or to protect the rights, safety, or property of Claims Northwest, our clients, or others;
• In connection with a merger, acquisition, or sale of business assets, subject to comparable privacy protections.

We do not sell your personal information or your health information, and we do not share your information with third parties for their own independent marketing or advertising purposes.

4Data Retention

We retain claim-related information for as long as needed to provide services, pursue your claim, and satisfy legal, tax, insurance, and recordkeeping obligations. Absent a longer period required by law or by a signed agreement, we securely delete or de-identify claim-related information within six (6) years following claim resolution or file closure.

5Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect your information, including restricting storage of medical records and other sensitive documents to secure, access-controlled platforms, and limiting internal access to information on a need-to-know basis. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

6Washington My Health My Data Act Disclosures

Claims Northwest, LLC is based in Washington State, and this Section is provided pursuant to the Washington My Health My Data Act ("MHMDA"). "Consumer health data" under the MHMDA means personal information that is linked or reasonably linkable to a consumer and that identifies the consumer's past, present, or future physical or mental health status, which, in connection with your interaction with us, may include your diagnosis, treatment history, and related medical records.

a. Categories of Consumer Health Data We Collect and Their Purpose

• Diagnosis and treatment information you or your healthcare providers give us — collected and used solely to evaluate and document your eligibility for, and to support the filing of, your RECA claim.
• Medical records obtained from healthcare providers pursuant to your signed authorization — collected and used for the same claim-related purposes, and shared only with your attorney and, through your attorney, the Department of Justice, as necessary to process your claim.

b. How We Collect Consumer Health Data

We collect consumer health data directly from you (through intake forms and consultations) and from your healthcare providers, pursuant to a signed medical records authorization you provide.

c. Sharing of Consumer Health Data

We share consumer health data only with your attorney, with records custodians for the limited purpose of fulfilling records requests you authorize, with the Department of Justice through your attorney, and with service providers who store or process this information on our behalf under confidentiality obligations, as described in Section 3. We do not sell consumer health data, and we do not share consumer health data with third parties for advertising purposes.

d. Your MHMDA Rights

Subject to certain exceptions permitted by law, you have the right to:

• Confirm whether we are collecting, sharing, or selling your consumer health data, and to access that data;
• Withdraw your consent to our collection or sharing of your consumer health data;
• Request deletion of your consumer health data, subject to our need to retain records required to complete an active claim, comply with law, or satisfy contractual and professional obligations to you and your attorney.

You may exercise these rights by contacting us using the information in Section 11. We will respond to verifiable requests within the timeframe required by law. You may appeal a denial of a rights request by contacting us using the same information; if your appeal is denied, you may submit a complaint to the Washington State Attorney General.

e. Consent

By signing the Claims Administration Agreement and any related medical records authorization, you provide affirmative consent for us to collect and share your consumer health data for the purposes described in this Policy. You may withdraw that consent prospectively at any time, understanding that doing so may limit or end our ability to pursue your claim.

f. Geofencing

We do not use geofencing technology around healthcare facilities or any other location to collect consumer health data, identify or track consumers seeking health care services, or send notifications, messages, or advertisements related to consumers' consumer health data or health care services.

7Your Privacy Choices and Rights

Depending on your state of residence, you may have additional rights over your personal information, which may include the right to access, correct, or delete personal information we hold about you, and the right to opt out of certain processing. To exercise any of these rights, contact us using the information in Section 11. We will verify your identity before responding and may need to retain certain information to complete an active claim or comply with legal obligations. You may also revoke any authorization for release of records at any time in writing; revocation does not affect records already released before we receive your revocation.

8Cookies and Tracking Technologies

The Site may use cookies and similar technologies to operate correctly, remember preferences, and understand how visitors use the Site, including through analytics tools. We use Cloudflare, including its web analytics service, to help operate, secure, and measure traffic on the Site. We do not turn on analytics or similar tracking until you accept cookies through the banner shown when you first visit; you can also control cookies through your browser settings. Disabling cookies may affect some Site functionality.

9Children's Privacy

The Site and our services are intended for adults evaluating eligibility for RECA benefits on their own behalf or on behalf of an eligible family member. We do not knowingly collect personal information directly from children under 13.

10Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. The "Effective Date" above reflects the date of the most recent revision. Material changes will be posted on the Site.
