These Terms govern your access to and use of recajustice.com, operated by Claims Northwest, LLC. Please read them carefully before using the Site or our services.
These Terms of Use ("Terms") govern your access to and use of the website located at recajustice.com (the "Site"), operated by Claims Northwest, LLC ("Claims Northwest," "CNW," "we," "us," or "our"). By accessing or using the Site, submitting a form, scheduling a consultation, or otherwise engaging our services, you ("you" or "User") agree to be bound by these Terms and by our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, please do not use the Site or our services.
Claims Northwest, LLC is a claims administration company. We are not a law firm, and we do not provide legal advice or legal representation. Claims Northwest assists individuals in gathering, organizing, and preparing documentation in connection with claims filed under the Radiation Exposure Compensation Act (RECA), as reauthorized under the One Big Beautiful Bill Act. Legal review, legal advice, and representation before the U.S. Department of Justice are provided separately by a licensed attorney, currently Nathan Anderson of Anderson Injury Law, LLC, under a separate representation agreement between you and that firm. Use of the Site does not, by itself, create an attorney-client relationship with Claims Northwest, LLC or with Anderson Injury Law, LLC. An attorney-client relationship is formed only upon execution of a signed representation agreement with Anderson Injury Law, LLC.
The Site and the services described on it are intended for individuals who believe they may be eligible for compensation under RECA, including qualifying Downwinders, Onsite Participants, Uranium Workers, and Manhattan Project waste-site residents, and their eligible survivors or spouses. You must be at least 18 years old, or acting as the legal representative of an eligible individual, to submit information through the Site or to engage our services.
Services offered in connection with the Site may include:
Claims Northwest does not itself file claims with, or make representations to, the Department of Justice. All formal submissions and legal filings are made by or under the supervision of your attorney.
Eligibility determinations and award amounts under RECA are made solely by the U.S. Department of Justice. Nothing on the Site, and nothing communicated by Claims Northwest personnel, constitutes a promise, warranty, or guarantee that you qualify for compensation, that a claim will be approved, or as to the amount or timing of any award. Past results described on the Site, if any, do not predict or guarantee similar outcomes in any other case.
Claims administration services are provided on a contingency basis. Claims Northwest charges a flat administration fee, and a separate attorney fee is charged by your attorney, each as set out in the written agreements you sign at intake (the Claims Administration Agreement and the attorney representation agreement). No fee is owed to Claims Northwest or to your attorney unless and until you receive compensation under RECA, except as otherwise stated in those agreements. The specific fee amounts and payment terms are governed exclusively by those signed agreements and not by this Site.
When you submit information through an intake form, scheduling tool, or telephone or video consultation, you represent that the information you provide is true, accurate, and complete to the best of your knowledge. You are responsible for promptly notifying us of any change to your contact information or to facts relevant to your potential claim. Providing false or misleading information may affect your eligibility for RECA benefits and may result in termination of services.
By using the Site and providing your contact information, you consent to receive communications from us electronically, including by email, text message, and telephone, including through the use of automated systems, regarding your potential claim. You may withdraw this consent at any time by contacting us using the information in Section 19. Where you sign documents electronically (including through DocuSign or a comparable e-signature platform), you agree that your electronic signature is the legal equivalent of your handwritten signature and is binding to the same extent.
All text, graphics, logos, video content, and other materials on the Site are owned by or licensed to Claims Northwest, LLC and are protected by copyright, trademark, and other intellectual property laws. You may view and download material from the Site for your personal, non-commercial use only. You may not reproduce, distribute, modify, or create derivative works from any content on the Site for commercial purposes without our prior written consent.
The Site and our workflow may reference or link to third-party services, including the Department of Justice's RECA claims portal, e-signature providers, scheduling tools, and payment processors. We do not control and are not responsible for the content, privacy practices, or terms of use of third-party services. Your use of any third-party service is governed by that provider's own terms and privacy policy.
Content on the Site is provided for general informational purposes only and does not constitute legal, medical, tax, or financial advice. You should not rely on the Site as a substitute for individualized advice from a qualified attorney, physician, or financial advisor regarding your specific circumstances.
THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE FULLEST EXTENT PERMITTED BY LAW, CLAIMS NORTHWEST, LLC AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR OUR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE SHALL NOT EXCEED THE AMOUNT, IF ANY, YOU PAID TO CLAIMS NORTHWEST, LLC FOR CLAIMS ADMINISTRATION SERVICES. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
You agree to indemnify and hold harmless Claims Northwest, LLC and its owners, employees, contractors, and agents from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Site, your breach of these Terms, or your submission of false or misleading information.
The validity, performance, and construction of these Terms shall be governed by the laws of the State of New Mexico, without regard to its conflict-of-laws principles.
In the event of any dispute, claim, question, or disagreement arising from or relating to these Terms, your use of the Site, or the services described on it, or the breach thereof, you and Claims Northwest, LLC mutually agree to resolve any justiciable disputes between you exclusively through final and binding arbitration in Albuquerque, New Mexico. This agreement to arbitrate applies to any and all claims arising out of or relating to these Terms, the Site, or your relationship with Claims Northwest, LLC, past, present, or future, whether arising under federal, state, or local statutory and/or common law. This arbitration provision does not apply to, and does not limit, any separate arbitration, forum-selection, or dispute-resolution provision contained in a signed Claims Administration Agreement or attorney representation agreement, which governs disputes arising under those agreements.
We may update these Terms from time to time. The "Effective Date" at the top of this page reflects the date of the most recent revision. Material changes will be posted on the Site, and continued use of the Site after changes are posted constitutes acceptance of the revised Terms. These Terms do not modify the terms of any separately signed client agreement.
We may suspend or terminate your access to the Site at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, to us, or to third parties. Termination of Site access does not affect the terms of any separately signed client agreement.
If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
